OVERVIEW
Welcome to Aliviro. The terms "we", "us" and "our" refer to JerseyFC LLC, trading as Aliviro, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.
These terms, together with the policies they refer to (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to these Terms and to our Privacy Policy.
Nothing in these Terms limits or excludes your statutory rights as a consumer, including your rights under the consumer law of the country where you live. Where a term below would conflict with those rights, those rights prevail.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority where you live. When you buy from us you may be asked for information such as your email address, phone or WhatsApp number, billing, payment and delivery details. You confirm that the information you give us is correct, current and complete. You are responsible for keeping your account credentials secure.
SECTION 2 - OUR PRODUCTS
We describe our products as accurately as we can. Colours can look different on different screens. We may stop selling a product at any time; this does not affect orders we have already accepted.
SECTION 3 - ORDERS, CANCELLATION AND RETURNS
When you place an order, you make an offer to buy. The contract is formed when we confirm your order by email. We may decline an order, for example if a product cannot be made for your car or cannot be delivered to your address; if we do, we refund any payment in full.
Custom-fit car mats are made to order for your car: before we cut anything, we confirm your car's details with you, and you can cancel free of charge until we start cutting. Because they are made to your specifications, the 14-day right to cancel does not apply to them; our Perfect-fit promise applies instead, in addition to your legal guarantee.
The portable clothes dryer comes with a 14-day right to withdraw.

You confirm that your purchases are for your own personal or household use and not for resale.
SECTION 4 - PRICES AND PAYMENT
The price you pay is the price shown when you place your order, and it is set out in your order confirmation email. Prices for delivery to the European Union include VAT, and delivery is free on all our products. For deliveries to the United Kingdom, the carrier may collect import VAT or a handling fee from you on delivery; this is set and collected by the carrier and is not part of the price you pay us. Payment is taken at checkout through Shopify's secure checkout; we do not store your card details. We may change prices and promotions for future orders at any time.
You confirm that you are authorised to use the payment method you provide.
SECTION 5 - DELIVERY
We deliver only to the countries listed in our Shipping Policy, within the delivery times stated there and on each product page. Your order is our responsibility until it is delivered to you or to someone you name. If a delivery is late, lost or damaged, contact us and we will put it right; your legal rights if delivery is late are not affected.
SECTION 6 - INTELLECTUAL PROPERTY
The Services, including all trademarks, brands, text, images, graphics, video and audio, and their design, selection and arrangement, are owned by JerseyFC LLC, its licensors or the respective owners, and are protected by copyright, trademark and other intellectual property laws. You may use the Services for your personal, non-commercial use only. You must not copy, distribute, modify or republish material from the Services without our prior written consent. Shopify's name, logo and product names are trademarks of Shopify. All other names and logos on the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
We may give you access to third-party tools that we do not monitor or control. We provide access to such tools as they are, and your use of them is subject to the terms of their providers. New features we add to the Services are also covered by these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for their content, products or practices. Please review their terms and policies before you use them.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Aliviro is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with JerseyFC LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and JerseyFC LLC, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with JerseyFC LLC.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is handled under our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and with third parties that may be located in other countries, in order to provide the Services to you.
SECTION 11 - FEEDBACK AND REVIEWS
If you send us ideas, suggestions, feedback or reviews ("Feedback"), you give us a free, non-exclusive, worldwide licence to use, reproduce and publish that Feedback in connection with the Services. You confirm that your Feedback is your own, is truthful, discloses any incentive you received, and does not infringe anyone's rights or contain unlawful material. We may remove Feedback that breaks these Terms or the law.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
If we find an obvious error in a price or product description, we will tell you before we accept your order or as soon as we notice it, and you may then cancel for a full refund.
SECTION 13 - PROHIBITED USES
You may use the Services for lawful purposes only. You must not use them to break any law, infringe anyone's rights, harass or harm others, send false or misleading information, spam, impersonate anyone, upload malicious code, collect other people's personal information, scrape or copy the Services, or interfere with their security. We may suspend or close an account that breaks these Terms.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 15 - TERMINATION
We may suspend or end your access to the Services if you break these Terms. This does not affect orders we have already accepted or your rights under them. Sections that by their nature should continue (including intellectual property, liability and governing law) continue to apply.
SECTION 16 - INFORMATION ON THE SERVICES
We aim to keep the Services available and accurate, but we cannot promise that they will always be uninterrupted or error-free. The products you buy from us come with the legal guarantee described in our Refund Policy, and nothing in these Terms limits it.
SECTION 17 - LIMITATION OF LIABILITY
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, or for business losses. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for defective products under product liability law, or for anything else that cannot be limited or excluded by law, including your statutory rights as a consumer.
SECTION 18 - INDEMNIFICATION
To the extent the law allows, you agree to compensate us for claims made by third parties that arise from your deliberate misuse of the Services or your breach of Section 13. This does not apply to your normal use of the Services as a consumer.
SECTION 19 - SEVERABILITY
If a court finds any part of these Terms unlawful or unenforceable, the rest of the Terms remain in force.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
If we do not enforce a right under these Terms straight away, we may still enforce it later. These Terms, the policies they refer to and the information on the product page you ordered from form the whole agreement between you and us for your order. If anything in them is unclear, it is read in your favour.
SECTION 21 - ASSIGNMENT
You may not transfer your rights under these Terms without our consent, except that the legal guarantee and our Perfect-fit promise follow the product. We may transfer our rights and obligations to another business, provided this does not reduce your rights.
SECTION 22 - GOVERNING LAW
These Terms are governed by the laws of the State of New Mexico, USA. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of that country.
SECTION 23 - HEADINGS
The headings in these Terms are for convenience only and do not affect their meaning.
SECTION 24 - CHANGES TO TERMS OF SERVICE
The current version of these Terms is always on this page. We may update them from time to time. The Terms that apply to your order are the ones in force when you placed it.
